The following terms of use apply to the use of the "EVZ Academy – online platform" (hereinafter referred to as "EVZ Academy") of the Foundation Remembrance, Responsibility and Future (EVZ), Friedrichstraße 200, 10117 Berlin.
With the EVZ Academy, the EVZ Foundation offers a digital platform for learning and networking for people (hereinafter referred to as "users") who are interested in the topics covered by the EVZ Foundation. After registering, users can attend thematic courses and events (online and offline) and exchange experiences. The offering also includes learning progress tracking, the receipt of certificates, the sending of personal messages to other users within the community, and the creation of your own content. The EVZ Academy can be used by users free of charge in accordance with the following terms of use.
With the EVZ Academy, the EVZ Foundation provides an internet platform where educational content in the form of e-learning modules (with text, audio and video components and interactive elements) can be accessed free of charge. Users can also make use of the following services free of charge:
Anyone interested in the topics covered by the EVZ Foundation can use the EVZ Academy, which requires registration.
In order to use the EVZ Academy, which requires registration, users must first register on the website academy.stiftung-evz.de. Registration is free of charge. At the same time, users will be informed about the EVZ Academy's data protection regulations. Personal data will be processed in accordance with the principles of the GDPR ( ). After registration, users will receive an email with a confirmation link. Upon activation of the user account, a free usage agreement between the user and the EVZ Foundation (hereinafter referred to as the "usage agreement") comes into effect. Users have no right to register and activate a user account. The registration and activation of a user account is at the sole discretion of the EVZ Foundation. In particular, the EVZ Foundation is entitled to exclude persons from using the EVZ Academy, which requires registration, and to refuse registration.
Users are not entitled to allow third parties to use their user account. They are also obliged to keep their access data secret and to protect it from access by unauthorised third parties. The account is generally limited to use by one user.
Users grant the EVZ Foundation a non-exclusive, non-transferable, free, perpetual right of use to the content they create via the EVZ Academy.
The EVZ Academy is intended exclusively for the use and implementation of the e-learning modules offered here and for internal communication. This includes, in particular, exchanges between learners and teachers as well as between users for these purposes.
By publishing content within the framework of the EVZ Academy, users affirm that they are the owners of all necessary rights. Users undertake not to publish, distribute and/or reproduce any contributions that violate applicable law or morality, in particular not to publish any contributions
If users upload and/or make available content in the EVZ Academy that violates the above rules of conduct, the EVZ Foundation has the right to delete it immediately upon becoming aware of it.
Users undertake to treat all other users, authors and speakers of the EVZ Academy with respect. The EVZ Foundation provides users with netiquette recommendations on how to behave responsibly when using the EVZ Academy and the internet in general.
Furthermore, users undertake not to unauthorisedly alter, delete, suppress, render unusable and/or use in any way other than for its intended purpose any data to which they gain access through their use of the EVZ Academy.
Unless expressly stated otherwise, the EVZ Foundation grants users a simple, spatially and temporally unrestricted right to use the graphics, images, user interface, audio contributions, video contributions and editorial content of the EVZ Academy exclusively for the following purposes:
Use may include reproduction, distribution or exhibition in accordance with Section 15 (1) of the Copyright Act, e.g. on posters or worksheets, or public reproduction in accordance with Section 15 (2) of the Copyright Act, e.g. through lectures, performances or the reproduction of image or sound carriers. Any use beyond this is only permitted with the prior written consent of the EVZ Foundation. Commercial use is not permitted.
Users undertake to use all of these works or parts thereof – insofar as they are made available to users for use within the framework of the EVZ Academy – exclusively for and within the framework of the EVZ Academy in accordance with these terms of use and the user agreement.
a. Authorisation to change the use of the EVZ Academy
The operation of the EVZ Academy and the services and educational content offered through the EVZ Academy are at the sole discretion of the EVZ Foundation. All offers are subject to change and non-binding. The EVZ Foundation expressly reserves the right to change, supplement or delete parts of the EVZ Academy or the entire EVZ Academy offering at any time at its own discretion and without giving reasons, or to temporarily or permanently discontinue the content and/or services, provided that this does not unreasonably disadvantage the interests of users. However, before making any changes to the EVZ Academy that affect data stored by users on , in particular participation certificates and other certificates, the EVZ Foundation will notify users in good time to enable them to save and back up this data.
b. Termination of use/deletion of user accounts
The user agreement between users and the EVZ Foundation is concluded for an indefinite period and may be terminated by either party in writing (e.g. by email) without notice. Upon termination of the user agreement, the EVZ Foundation is obliged to delete the personal data associated with the user accounts.
If there is good cause, the EVZ Foundation is entitled to immediately block the user's access to the EVZ Academy and to terminate the user agreement without notice. In this case, the user in question may only re-register after obtaining the prior consent of the EVZ Foundation in writing, e.g. by email.
Users are free to delete their user accounts themselves at any time and with immediate effect via their personal settings. Upon deletion of the user account by the user, the user agreement automatically ends with immediate effect. Before deletion, users will be asked whether they wish to download any certificates/participation certificates they have acquired, as these will also be irretrievably deleted when the user account is deleted.
In the event of termination of the user agreement or deletion of the user account, personal data will be anonymised, i.e. changed in such a way that the user can no longer be identified on the basis of the anonymised data after termination of the user agreement or deletion of the user account.
The EVZ Foundation does not guarantee the accuracy, completeness, reliability, quality, timeliness or usability of the EVZ Academy's free services.
Liability shall exist exclusively in accordance with this Section 6.
The EVZ Foundation's liability is not limited to:
Otherwise, the EVZ Foundation's liability for damages, regardless of the legal basis, is excluded.
Claims under the Product Liability Act remain unaffected by the provisions of this Section 6. The above exclusions and limitations of liability apply to the same extent in favour of the organs, legal representatives, employees and other vicarious agents of the EVZ Foundation.

The links provided on the EVZ Academy website refer to publications that are not the responsibility of the EVZ Foundation. The EVZ Foundation is only liable for links that are outside its area of responsibility if it is aware of the content and it would be technically possible and reasonable for it to prevent the use of illegal content.
All pages referred to by links on the EVZ Academy website of the EVZ Foundation were checked for content at the outset. Due to the changeability of the pages to which links have been set, it is not legally reasonable for the EVZ Foundation to constantly check them for illegal content.
a. Updating and changing the terms of use
The EVZ Foundation reserves the right to change these terms of use at any time without giving reasons. The EVZ Foundation will inform users of any changes in good time and ask for their consent to the amended Terms of Use. If users do not object to the changes, the Terms of Use shall be deemed to have been accepted. If users object, their participation will be terminated before the amendment to the Terms of Use comes into effect and their user account will be deleted.
b. Place of jurisdiction/applicable law
These Terms of Use and the User Agreement are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Legal proceedings may be brought before the courts with local jurisdiction in accordance with the statutory provisions.
c. Severability clause
Should one or more provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions. In this case, the statutory provisions shall apply instead.
